Terms of Service

1. Who We Are (Trader Information)

These Terms of Service ("Terms") are a legal agreement between you and MobMonks IT Solutions ("MobMonks", "we", "us", "our"). We act as a trader — a business offering games and apps to consumers — including for the purposes of consumer protection law in the European Economic Area (EEA) and the United Kingdom (UK).

Trader self-certification: MobMonks IT Solutions commits to only offer products or services that comply with applicable laws, including applicable EU and UK law.

2. Scope and Acceptance

These Terms apply to every current and future MobMonks game, app, demo, and related service (together, the "Services"), wherever you get them — including Google Play, the Apple App Store, Steam, and itch.io. A specific game may have additional terms shown in-game or on its store page; if they conflict with these Terms, the game-specific terms apply to that game.

By downloading, installing, accessing, or using any Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

3. Eligibility

Our Services are not directed at children under 13. If you are under the age of legal majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for any purchases you make.

4. License to Use the Services

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the Services for your own non-commercial entertainment on devices you own or control, in line with the rules of the store you obtained them from.

You may not: copy, modify, or redistribute the Services; reverse engineer or decompile them except where the law expressly allows; use cheats, bots, exploits, or unauthorized third-party software; interfere with servers, ads, or analytics; or use the Services for any unlawful purpose.

Content creators may stream, record, and monetize videos of our games, provided you don't imply our endorsement and don't redistribute the game itself.

5. Purchases, Pricing, and Payment

Paid games, in-app purchases, and subscriptions are sold through the store you use (Google Play, the App Store, Steam, or itch.io). That store processes the payment, and its own terms of sale apply in addition to these Terms. Prices are shown in the store before you buy, including any taxes the store is required to show.

Subscriptions (where offered) renew automatically until cancelled. You can cancel at any time in your store account's subscription settings; cancellation takes effect at the end of the current billing period.

6. Virtual Currency and In-Game Items

Some games let you earn or buy virtual currency, items, or other digital content ("Virtual Items"). Virtual Items are licensed to you, not sold; they have no real-world monetary value and cannot be exchanged for cash, transferred, or traded outside the game except where a game expressly allows it. We may adjust game balance, pricing, or how Virtual Items work, but we will not remove Virtual Items you have paid for without good reason, such as a breach of these Terms or a game being discontinued under Section 12.

Where a game includes randomized rewards (for example loot boxes or scratch cards), the game will disclose this before purchase as required by the relevant store and applicable law. No MobMonks game offers real-money gambling or prizes of real-world value.

7. Your Consumer Rights (EEA, UK, and Elsewhere)

Nothing in these Terms limits any mandatory rights you have as a consumer under the law of the country where you live. In particular, if you live in the EEA or the UK:

• Right of withdrawal: You normally have 14 days to withdraw from a contract for digital content. When you buy a game or in-app item that is delivered immediately, you are asked to agree to immediate delivery and to acknowledge that you lose your right of withdrawal once delivery begins. If you have not given that consent, you keep your 14-day withdrawal right. Subscriptions you have not started using may be withdrawn from within 14 days.
• Conformity: Digital content we supply must match its description, be fit for purpose, and be of satisfactory quality. If it is not, you are entitled to have it fixed or, where that's not possible, to a price reduction or refund, as provided by law.
• Refunds through stores: Each store also has its own refund policy (for example, Google Play's and Steam's refund windows), which you can use in addition to your statutory rights.

To exercise any of these rights, contact us at contact@mobmonks.com with your order details, or request a refund directly from the store you purchased from.

8. Advertising and Third-Party Services

Free and freemium games may show ads provided by third parties such as Google AdMob and Meta Audience Network. Our games may also rely on third-party services (stores, sign-in providers, analytics). We are not responsible for third-party websites, products, or services, and their own terms and privacy policies apply. See our Privacy Policy for details on data collected.

9. User Conduct and Multiplayer Features

Where a game includes multiplayer, chat, leaderboards, or user-generated content, you agree not to harass, threaten, or impersonate others; post unlawful, hateful, or sexually explicit content; cheat or manipulate leaderboards; or infringe others' rights. We may remove content, reset scores, or suspend access for breaches of this section. Content you submit remains yours, but you grant us a worldwide, royalty-free license to host and display it as needed to operate the game.

10. Intellectual Property

The Services — including code, artwork, characters, music, names, and logos — are owned by MobMonks IT Solutions or its licensors and are protected by intellectual property laws. Except for the license in Section 4, no rights are granted to you.

If you believe content in our Services infringes your rights, email contact@mobmonks.com with details and we will investigate promptly.

11. Feedback

If you send us ideas or suggestions, we may use them freely without any obligation to you.

12. Updates, Availability, and Discontinuation

We may release updates, fixes, or new content, and some updates may be required to keep playing. We aim to keep our games available, but we may discontinue a game or online feature. Where a game with paid content or online features is to be shut down, we will give reasonable advance notice (at least 30 days where practicable) in-game or on our website, and you keep any statutory refund rights.

13. Suspension and Termination

You may stop using the Services at any time by uninstalling them. We may suspend or end your access if you seriously or repeatedly breach these Terms, or where required by law. Where reasonable, we will tell you why and give you a chance to respond. Sections 6, 10, 14, 15, and 17 survive termination.

14. Disclaimer

To the extent permitted by law, the Services are provided "as is" and "as available", and we do not promise that they will be uninterrupted or error-free. This does not affect the statutory conformity rights described in Section 7, which cannot be excluded.

15. Limitation of Liability

To the extent permitted by law, MobMonks is not liable for indirect, incidental, or consequential losses, or for loss of data or profits, and our total liability to you for any claim related to the Services is limited to the amount you paid us for the relevant Service in the 12 months before the claim. Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that cannot be limited under applicable law, including mandatory consumer protection law in the EEA and UK.

16. Support and Complaints

For help, refunds, or complaints, email contact@mobmonks.com and include the game name, platform, and (for purchases) your order number. We aim to acknowledge messages within 5 business days and to resolve complaints within 30 days. We are not obliged to take part in alternative dispute resolution, but consumers in the EEA and UK may contact their local consumer protection authority or advice service.

17. Governing Law and Disputes

These Terms are governed by the laws of India, and the courts of Thrissur, Kerala, India have jurisdiction. However, if you are a consumer living in the EEA, the UK, or another country with mandatory consumer laws, you keep the protection of those laws and may bring proceedings in the courts of your country of residence.

18. Additional Terms for Apple Devices

If you got a Service from the Apple App Store, these Terms are between you and MobMonks, not Apple. Apple has no obligation to provide maintenance or support, is not responsible for addressing claims relating to the Service, and is a third-party beneficiary of these Terms with the right to enforce them against you. Your use must also follow Apple's Usage Rules in its Media Services Terms.

19. Changes to These Terms

We may update these Terms to reflect changes to our Services or the law. The current version will always be on this page with its effective date. For material changes, we will give reasonable notice in-game or on our website before they take effect. If you don't agree with the changes, you can stop using the Services; continued use after the effective date means you accept the revised Terms.

20. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours to a successor that continues to provide the Services, without reducing your rights. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Services.
